Governor Appoints Outfitter to IOGLB; Update on IOGLB/IOGA
Working Group
Idaho Governor Butch Otter has appointed outfitter Tom Long
who resides in the Boise
area to the Idaho Outfitters and Guides Licensing Board. Tom is a veteran
Payette river outfitter, and along with spouse Debbi and extended family, own
and operate Cascade Raft and Kayak. They also maintain an outdoor adventure
business in Chile.
Tom attended and participated in his initial IOGLB meeting in late April. Per Idaho statute and in
conjunction with the IOGA process, the IOGA sent the Governor the names two
qualified outfitter/guides this past winter. IOGA appreciates the fact that
both Tom and long time Main Salmon river guide IOGA member Mike Hovey, a
retired school teacher, were willing to be considered for this outfitter/guide
position on the IOGLB. Long joins outfitters Scott Farr of Challis and Will
Judge of St. Maries on the IOGLB. The IOGLB also includes Wayne Hunsucker who
represents the public and Marcus Gibbs, the Idaho Fish and Game Commission
representative. IOGLB terms are for three years. All must be confirmed by the
Idaho Senate.
During the late April IOGLB meeting, the board decided to
endorse potential legislation for the 2008 session that has been reviewed by
joint IOGLB/IOGA working group beginning last fall. Legislation topics
include:
Making it a misdemeanor for any person to provide outfitting
or guiding services to another person who the person knows, or reasonably
should have known, is not licensed. Believe it or not, the IOGLB does not have
clear authority related to this topic.
Providing the IOGLB with the ability to subpoenas as
permitted by the Idaho Administrative Procedures Act. Presently, it is a very
cumbersome process for the IOGLB to issue subpoenas.
Change the penalty section of the code to increase the
minimum for fines from $100 to $1,000 and the potential jail time not to exceed
one year. Currently, jail time is limited to 90 days. In addition, this
potential legislation would require violating the provisions of this section of
Idaho Code to reimburse the IOGLB, city, county, state or federal agency for
costs incurred in the investigation and prosecution for violations of section 36-2104
of Idaho Code.
The IOGLB decided that further focus on potential rule
changes would continue, but with a longer time frame for consideration by the
working group and the industry as a whole. The Mission Statement of the
IOGLB/IOGA Statute and Rules Working Group is as follows: The IOGLB and IOGA
work group will collaborate to study, review, clarify and propose changes to
strengthen the law and rules regulating the outfitting and guiding industry.
Working group members include outfitters Lonnie Allen, John A.K. Barker, Scott
Farr, Peter Grubb, Randy Hamilton, Will Judge, Chris Korell and Mark Yates. The
federal representative is LuVerne Grussing. Ex-oficio members include Jake
Howard, Grant Simonds, Steve Tobiason, Jeremy Pisca, Brad Compton and Bob Lund.
